  • Rules

    1. CARMINES rents cars for the time requested by a Customer but not shorter period then a day (24 hours)

    2. Documents: a Rent Agreement and a Transfer Protocol (Umowa Najmu, Protokół Przyjęcia-Przekazania) shall be drawn up by a CARMINES employee.

    3. Customer - an individual person or a legal person acting by a duly appointed representative – must:
    • be 21 years old
    • have a valid driving license
    • have a valid identity card
    • have another document of identity
    4. Before a car is leased to a customer, he/she shall be required to pay a security in the amount equal to a sum of driver's part of insurance compensation (udział własny w szkodzie)

    5. If a car requested by a phone is not taken by a customer, he/she shall be required to pay a booking cost of PLN 500.00

    6. Hired car must not be driven by a person not mentioned in the Rent Agreement; further, the car must not tow other vehicle, be overloaded, participate in sports competition of any kind.

    7. Customers shall be responsible for lack of fuel, parts and/or equipment, as well as for any loss due to his/her behaviour, including insufficient protection of the car and its documents.

    8. If the car is damaged by the Customer who had drunk an alcoholic drink(s) before, he/she shall have to pay for the car repair cost as well as for its halt in a garage - a day hire rate for each day of halt.

    9. Hire pay shall be paid in advance in accordance with a rate of hire due on the day of hiring a car.

    10. In case of return of the car before the last agreed day, no money shall be paid back to the Customer by CARMINES.

    11. A car released to a Customer shall be in good technical order and shall have fuel in agreed amount; It shall be returned by a Customer in the same state and condition.

    12. If the rent time agreed by the Parties is prolonged by a Customer with no agreement with CARMINES for more then 1 hour, a fee for 24-hour period shall be requested. In case of self-prolongation of hire period for more tten 24 hours, police shall be noticed of theft of the car. In such a case, Customer shall be responsible for all consequences, both legal and financial, resulting from police action.

    13. In case of prolongation of car hire period for more than 1 day (24 hours) with no agreement with CARMINES, we shall request the Customer to pay a penalty – a twice daily rent rate – for each day (24 hours) exceeding the rent time agreed by the Parties before.

    14. If the car becomes out-of-order during the time of rent, Customer shall have to inform CARMINES of it immediately. If the flaw or other disorder may threaten the safety of traffic, the car must not be driven before it is repaired

    15. If the damage of the car is a consequence of a road accident/collision, the Customer is obliged to call police, to take a written statement from the other participant(s), to receive a protocol made by an insurer and to protect the car.

    16. In the car damage is due to the Customer, he/she shall be obliged to pay a penalty of a day hire rate for each day of the car repair.

    17. Damages of tyres and interior of the car (by cigarettes for example) are not covered by insurance and shall be paid for by a Customer.

    18. If the car damage is due to Customer, the security paid by him/her shall not be returned.

    19. The so-called “own part of the driver” in insurance compensation may be excluded if the Customer buys his/her own insurance policy.

    If any of the above provisions is not obeyed by the Customer, his/her security shall be retained and a penalty of 10 to 30 times of a daily rent rate may be requested by CARMINES.

    21. Customer does hereby agree and consent to processing of his/her personal details by CARMINES to execute the Agreement in accordance with relevant laws (Dz.U. 1997, Nr v133, poz.883). If the Customer does not obey his/her obligations of the Agreement or if he/she presents false data and statements, CARMINES shall have the right to pass the Customer's and other drivers' data (including photographs) to relevant authorities as well as to register him/her as fraudulent clients in relevant databases.

    22. Customer does hereby authorize CARMINES to issue a V.A.T. invoice for the services agreed upon in the Agreement without his/her signature.

    23. All disputes resulting from execution of the Agreement shall be resolved by Regional Court of Kraków-Nowa Huta (Sąd Rejonowy dla Krakowa-Nowej Huty).
